1. Agreement to Terms

By requesting, scheduling, or using any towing, roadside assistance, or related services (“Services”) provided by AMI Towing Service (“Company,” “we,” “us,” or “our”), you (“Customer,” “you,” or “your”) agree to be bound by these Terms and Conditions. If you do not agree to these terms, do not use our Services.

2. Estimated Times of Arrival (ETAs)

Any estimated time of arrival, response time, or similar timeframe provided by the Company (including but not limited to verbal estimates, in-app or website estimates, or dispatcher communications) is an estimate only and is not guaranteed. ETAs may be affected by traffic, weather, road conditions, prior service calls, and other factors beyond our control. The Company shall not be liable for any loss, cost, or inconvenience resulting from actual arrival times that differ from any stated or implied estimate. You acknowledge that you do not rely on any ETA as a guarantee and that your use of our Services is not conditioned on our meeting any specific timeframe.

3. Refunds and Cancellation Policy

  • General refunds. Refunds, when applicable under this policy, will be issued in full minus any third-party transaction fees. Transaction fees are currently approximately four percent (4%) of the transaction amount and may be deducted from the refund amount.
  • Cancellation before driver is en route. If you cancel your service request before a driver has been dispatched or is en route to your location, you will receive a refund of ninety-six percent (96%) of the amount paid (reflecting the deduction of applicable transaction fees).
  • Cancellation after driver is en route. If you cancel after a driver has been dispatched or is en route to your location, a “gone on arrival” (GOA) or cancellation fee will apply. You will receive a refund of all amounts paid except the following GOA fee: (a) $65.00 for towing services, or (b) $35.00 for jump start, lockout, tire change, or fuel delivery services. The applicable GOA fee depends on the type of service you requested. No additional refund will be given beyond the amount paid minus the GOA fee and any transaction fees.

Refund eligibility and amounts are determined solely by the Company in accordance with this policy. Refunds may take several business days to process. The Company reserves the right to modify this refund and cancellation policy with notice where required by law.

4. Limitation of Liability; Assumption of Risk; Hold Harmless

Release and hold harmless. To the maximum extent permitted by applicable law, you hereby release, hold harmless, indemnify, and forever discharge the Company, its owners, officers, employees, agents, contractors, insurers, and affiliates (collectively, “Released Parties”) from and against any and all claims, demands, damages, losses, costs, expenses, and liabilities (including reasonable attorneys’ fees) of any kind or nature, whether known or unknown, suspected or unsuspected, arising out of or in any way related to the Services, your use of the Services, or your interaction with the Company or any driver, including but not limited to:

  • Damage to your vehicle, property, or the property of any third party;
  • Personal injury or death to you or any third party;
  • Delay, failure to perform, or errors in the provision of Services;
  • Acts or omissions of drivers, subcontractors, or third parties;
  • Road conditions, weather, or other circumstances before, during, or after service.

No liability. The Company is not liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or related to the Services or these Terms, including without limitation loss of use, loss of profits, or any other economic loss. You assume all risk of loss, damage, or injury to your person and property in connection with the Services. You acknowledge that towing and roadside assistance involve inherent risks and that the Company does not guarantee any particular outcome or condition of your vehicle or property after service.

Indemnification. You agree to indemnify and hold the Released Parties harmless from any claims, losses, or expenses (including attorneys’ fees) brought by you or any third party arising from your use of the Services or your breach of these Terms. These limitations and releases apply even if the Company has been advised of the possibility of such damages and regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise). Some jurisdictions do not allow the exclusion or limitation of certain damages; in such jurisdictions, our liability shall be limited to the greatest extent permitted by law.

5. Service Description and Pricing

Quotes and prices provided are estimates and may change based on actual service required, location, vehicle type, and other factors. Final charges will be communicated and collected in accordance with our then-current practices. You are responsible for providing accurate information regarding your location, vehicle, and service needs. The Company reserves the right to refuse or discontinue service at its sole discretion for safety, fraud prevention, or other legitimate reasons.

6. SMS Text Messaging

By providing your phone number to AMI Towing Service, you agree to receive SMS (text) messages related to our Services. These messages are strictly related to services you have requested and are not unsolicited marketing messages.

Types of messages. You may receive texts about service confirmations and dispatch updates, estimated time of arrival notifications, job status updates, customer support, and post-service follow-up (including requests for feedback or reviews).

Frequency. Message frequency depends on your interaction with us; you will generally only receive messages related to active or recently completed service requests.

Consent. You consent to SMS by calling us and providing your number, submitting a service request through our website, or otherwise requesting towing or roadside assistance. Your consent is not a condition of purchase.

Opt-out. Reply STOP to any message to opt out. You will receive a confirmation and will not receive further SMS from us unless you contact us again and choose to receive messages.

Charges. Message and data rates may apply according to your mobile carrier and plan. AMI Towing Service is not responsible for charges your carrier bills you.

Privacy. We use your phone number for service-related communications. We do not sell, rent, or share your number with third parties for their marketing. For more detail, see our Privacy Policy.

Carriers. SMS is supported by most major U.S. carriers; delivery is not guaranteed and may depend on your provider and device.

7. General Provisions

These Terms constitute the entire agreement between you and the Company regarding the Services. No waiver of any term shall be deemed a continuing waiver. If any provision is held invalid or unenforceable, the remaining provisions shall remain in effect. The Company may update these Terms from time to time; continued use of the Services after changes constitutes acceptance of the revised Terms. These Terms are governed by the laws of the State of Minnesota without regard to conflict of law principles. Any dispute shall be resolved in the state or federal courts located in Minnesota, and you consent to personal jurisdiction therein.
